Terms of Service

1. Agreement

1.1 These Terms of Service (the "Terms") form a binding agreement between you and Draco Foundry, LLC, an Alaska limited liability company ("Draco Foundry", "we", "us" or "our"), governing your access to and use of (a) the Open Hangar browser extension (the "Extension"); (b) the websites at openhangar.space and app.openhangar.space (the "Website"); and (c) any related sync, account and support services (together with the Extension and the Website, the "Services").

1.2 By installing the Extension, creating an account, or otherwise accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

1.3 Our collection and use of personal data is described in the Open Hangar Extension Privacy Policy and the Website Privacy Policy (together, the "Privacy Policies"), which are incorporated into these Terms by reference. Where these Terms and a Privacy Policy conflict on a matter of personal data, the Privacy Policy governs.

2. Eligibility

2.1 You must be at least 13 years of age, or any higher age required in your country to consent to the processing of your personal data without parental consent, to create an account on the Website.

2.2 By using the Services you represent that you meet these requirements and that you are not barred from using the Services under any applicable law.

3. The Services

3.1 The Extension reads data from your own Roberts Space Industries ("RSI") account using the session already active in your browser, and stores that data locally on your device. The Extension does not require a Website account.

3.2 The Website, if you choose to create an account and connect the Extension, stores a copy of the data the Extension sends and displays it to you. Sync is optional and is described in the Privacy Policies.

3.3 Add to RSI Cart and Send to RSI Cart. At your express instruction, the Extension may place items you choose, such as ship upgrades, buy-backs, paints, packs and gear, in your RSI cart through RSI's own store. The Extension never completes a purchase. Any purchase is made by you, on RSI, under RSI's terms, and is solely between you and RSI. We are not a party to, and have no responsibility for, any transaction with RSI, including pricing, availability, refunds or the contents of any item.

3.4 Information only. Values, prices, totals, exchange-rate conversions, loaner lists, buy-back details and any other figures shown by the Services are estimates derived from third-party and public sources. They are provided for information only, may be incomplete or out of date, and are not an offer, appraisal, guarantee or financial advice. You should confirm any detail on RSI before relying on it.

3.5 News summaries. The Website's front page may display summaries of RSI's public posts produced in part by automated tools, including artificial intelligence. Summaries may contain errors. The linked original post is the authoritative source.

3.6 Pre-release features. Features identified as beta, preview or test are provided for evaluation, may change or be withdrawn at any time, and are subject to Section 11 to the fullest extent permitted by law.

4. Accounts and Security

4.1 You must provide a valid email address and keep your sign-in credentials confidential. You are responsible for all activity under your account, except to the extent caused by our breach of these Terms.

4.2 You must notify us promptly at support@openhangar.space if you believe your account or a connected Extension has been accessed without your authorization. You may disconnect any Extension at any time from your Account page.

4.3 You may hold one account. You may sync only RSI accounts that you own or are authorized to access.

5. Your Responsibilities Regarding RSI

5.1 Your use of RSI's websites and services is governed by RSI's and Cloud Imperium Games' own terms and policies. You are solely responsible for ensuring that your use of the Extension in connection with your RSI account complies with those terms.

5.2 The Extension acts only on your own RSI account and only through the session you have already established. You must not use the Services to access any RSI account that is not yours.

5.3 We do not control RSI and are not responsible for any action RSI takes in respect of your RSI account, including any change, suspension or restriction.

6. Acceptable Use

You agree not to, and not to attempt to:

• (a) use the Services in violation of any applicable law or third-party right;
• (b) access, probe, scan or test the vulnerability of the Services, or breach any security or authentication measure, except through a responsible disclosure made to us in good faith;
• (c) interfere with or disrupt the Services, including by sending automated requests at a volume that imposes an unreasonable load;
• (d) create accounts by automated means, or circumvent any invitation, rate limit or access control;
• (e) use the Services to collect personal data about other people, other than the data the Extension reads from your own RSI account and what other users choose to share with you through the Services;
• (f) impersonate any person or misrepresent your affiliation with any person; or
• (g) resell, sublicense or commercially exploit the Website or its sync service without our prior written consent.

6A. Sharing, Public Profiles and Reports

6A.1 Sharing is optional. If you share ships with your org or turn on a public profile, you choose what is shown, and you can turn it off at any time. You must be 18 or older to turn on a public profile or to share by name.

6A.2 A public profile may show only what the Website lets you pick, and you are responsible for your choices. You must not use a profile, or a ship, paint, name or picture shown on it, to harass, threaten or impersonate anyone, to advertise or sell anything, or to show anything unlawful, hateful or sexually explicit.

6A.3 What other users share with you through the Services is for your own use within the Services. You must not copy it out in bulk, publish it elsewhere, or use it to contact, track or harass anyone.

6A.4 Any signed-in user may report a public profile. Anyone, with an account or not, may report a profile they believe shows illegal content by emailing support@openhangar.space with its address and the reason. Reports must be made in good faith. We do not tell a reported user who reported them, and we may limit reporting for accounts that misuse it.

6A.5 We may hide a public profile, or turn off sharing for an account, if we reasonably believe it breaks these Terms or the law. Hiding deletes nothing. When we hide your profile, the Sharing page tells you, and you can ask us why, or ask us to look again, at support@openhangar.space. We are not obliged to monitor what users share.

7. Your Data

7.1 As between you and us, you retain whatever rights you hold in the data you sync to the Website and in what you choose to show on your public profile, including your RSI picture (together, "Your Data").

7.2 You grant Draco Foundry a worldwide, non-exclusive, royalty-free license to host, store, copy, process and display Your Data solely to the extent necessary to provide the Services to you, including showing what you choose to share to the people you choose to share it with, and for no other purpose. This license ends when Your Data is deleted, subject to the backup retention periods stated in the Website Privacy Policy.

7.3 You represent that you have the right to sync Your Data and to show what you choose on your public profile, including your RSI picture.

7.4 You may download or delete Your Data at any time as described in the Website Privacy Policy.

8. Intellectual Property

8.1 The Extension's source code is made available under the license published in its repository at https://github.com/Draco-Foundry/open-hangar (the "Source License"). The Extension is source-available, not open source. Your rights to copy, modify or distribute the Extension's code are governed solely by the Source License.

8.2 Except as granted in the Source License and these Terms, Draco Foundry and its licensors retain all right, title and interest in and to the Services, including the Website, its software, design and content, and the names "Open Hangar" and "Draco Foundry" and associated logos. Nothing in these Terms grants you any right to use our names or logos.

8.3 Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Website for your own non-commercial purposes.

8.4 If you send us feedback or suggestions, we may use them without restriction or obligation to you.

8.5 Copyright. If you believe something shown through the Services infringes your copyright, send a notice to our designated copyright agent, whose details are on the Legal Notice. Include the work, where it appears on the Services, your contact details, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you own the copyright or may act for its owner, and your physical or electronic signature. We will remove or disable access to material where appropriate, and we will close the accounts of repeat infringers in appropriate circumstances.

9. Third-Party Services and Non-Affiliation

9.1 The Services interact with, link to, or rely on services operated by third parties, including RSI, Cloud Imperium Games, Discord, GitHub, Ko-fi, Patreon, star-citizen.wiki and starcitizen.tools. We do not control and are not responsible for those services, their content, or their availability. Your use of them is governed by their own terms.

9.2 Open Hangar is an unofficial, fan-made project. It is not affiliated with, endorsed by, or sponsored by Cloud Imperium Games, Roberts Space Industries or any of their affiliates. Star Citizen, Roberts Space Industries and related marks are the property of their respective owners.

10. Fees and Voluntary Support

10.1 The Services are currently provided free of charge.

10.2 Contributions made through Ko-fi, Patreon or similar platforms are voluntary gifts in support of the project. They are processed by those platforms under their own terms, do not purchase any good, service, feature or level of service, and do not create any obligation on our part, except as required by law.

10.3 If we introduce paid features, we will present their terms before you are charged, and you will not be charged without your express agreement.

11. Disclaimers

11.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY OR QUIET ENJOYMENT.

11.2 WITHOUT LIMITING SECTION 11.1, WE DO NOT WARRANT THAT (A) THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE; (B) THE SERVICES WILL CONTINUE TO FUNCTION AFTER ANY CHANGE BY RSI TO ITS WEBSITES; (C) ANY VALUE, PRICE OR OTHER INFORMATION SHOWN BY THE SERVICES IS ACCURATE OR COMPLETE; OR (D) USE OF THE EXTENSION WILL NOT AFFECT YOUR RSI ACCOUNT.

11.3 Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply only to the extent permitted by law.

12. Limitation of Liability

12.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DRACO FOUNDRY, ITS MEMBERS, MANAGERS, CONTRIBUTORS OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, IN-GAME ITEMS, PLEDGES OR STORE CREDIT, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.2 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, AND (B) FIFTY US DOLLARS (US$50).

12.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that cannot be excluded or limited under applicable law.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Draco Foundry from any third-party claim, loss or expense (including reasonable legal fees) arising out of your breach of these Terms or your violation of any law or third-party right. This Section does not apply to consumers in jurisdictions where such an obligation is unenforceable.

14. Suspension, Termination and Discontinuation

14.1 You may stop using the Services at any time. You may delete your account from your Account page, and you may remove the Extension by uninstalling it.

14.2 We may suspend or terminate your access to the Website, in whole or in part, if you materially breach these Terms, if required by law, or if necessary to protect the Services or other users. Where reasonably practicable, we will give you notice and an opportunity to download Your Data first.

14.3 Accounts with no sign-in and no sync for twenty-four (24) months are deleted, with prior email notice, as described in the Website Privacy Policy.

14.4 We may modify or discontinue any part of the Services. If we discontinue the Website, we will give account holders at least sixty (60) days' notice by email and keep data download available until closure, as described in the Website Privacy Policy.

14.5 Sections 7.4, 8, 9.2 and 11 through 17 survive any termination of these Terms.

15. Governing Law and Disputes

15.1 These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Alaska, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.2 Before bringing any claim, you agree to contact us at support@openhangar.space and give us thirty (30) days to try to resolve it informally.

15.3 Subject to Section 16, any claim that is not resolved informally shall be brought exclusively in the state or federal courts located in Anchorage, Alaska, and each party submits to the personal jurisdiction of those courts. Either party may instead bring an individual claim in a small claims court of competent jurisdiction.

16. Consumers Outside the United States

If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose law grants you mandatory protections, nothing in these Terms deprives you of those protections, including any right to bring proceedings in the courts of your place of residence. Where a provision of these Terms conflicts with such mandatory law, that law prevails to the extent of the conflict.

17. General

17.1 Changes. We may amend these Terms. We will post the amended Terms with a new "Last updated" date and, for material changes, notify account holders by email at least thirty (30) days before they take effect. Continued use of the Services after the effective date constitutes acceptance. If you do not agree, you must stop using the Services and may delete your account.

17.2 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition or transfer of all or substantially all of the assets relating to the Services, provided that the assignee agrees to be bound by these Terms and the Privacy Policies with respect to data already collected, and that account holders receive prior notice and the opportunity to delete their accounts as stated in the Website Privacy Policy.

17.3 Entire agreement. These Terms, together with the Privacy Policies and the Source License, constitute the entire agreement between you and us regarding the Services and supersede any prior agreement on that subject.

17.4 Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

17.5 No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.

17.6 Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including changes to or outages of RSI's services.

17.7 Notices. We may give you notice by email to the address on your account or by posting on the Website. You may give us notice at support@openhangar.space.

17.8 Language. These Terms are written in English. Any translation is provided for convenience only, and the English version governs.
